The following “General Eurojob24.net Business Terms” (hereinafter
referred to as the “Rules”) apply to physical and legal persons who use Wiarus
Services (hereinafter referred to as the “Members”.)
I. Eurojob24 Services
Eurojob24 enables the Members to post announcements
subject to the legislation in force and these Rules.
II. Registration
- To use Eurojob24 services, you must register with
Eurojob24 by filling in the registration form and clearly express you agree with
the terms and conditions of these Rules.
Registration means you enter the
agreement with Eurojob24 (hereinafter referred to as the “Agreement”) for using
provided resources.
- Members must provide correct and complete personal
information in the registration form.
- Registration procedure on behalf of a legal entity must
be carried out by the duly authorized person whose last name must be specified
in the registration form.
- Eurojob24 Members must immediately inform Eurojob24 of
any changes to their personal information.
- During registration, an applicant is asked to suplly his
or her username. Make sure your username is bias free and doesn’t violate any
third-parties' rights.
- Eurojob24 doesn’t give out passwords to the third parties
and doesn’t request passwords by phone or email. Members are responsible for
maintaining the confidentiality of their usernames and passwords. If there are
reasons to believe a username or a password has been compromized, Members must
immediately notify Eurojob24 about the case.
- Registration is free of charge. Eurojob24 reserves the
right to reject or discontinue registration without notice in the following
cases:
- Deliberate provisioning of incomplete or incorrect
personal information.
- Deliberate or accidental misuse of the announcement
database.
- Damaging the announcement
database.
Eurojob24 also reserves the right to reclaim the
damage resulting from the above mentioned actions. If Member's registration is
discontinued, he or she is deprived from using Eurojob24 Services any more and
registering anew.
III. Special Terms
- Using Eurojob24 Services may be subject to certain
conditions, e.g. verification of the registration data.
- Eurojob24 reserves the right of suspending service
provisioning in case this is absolutely necessary for resource maintenance
purposes in which case Eurojob24 will promptly notify Members. However,
announcement expiration date is not extended.
- Eurojob24 is not liable of any consequences resulting
from impossibility of using services because of the conditions, which are beyond
Eurojob24 control.
IV. Canceling Registration
- Members can cancel their registration at any time by
sending email to agb@wiarus.de.
- Eurojob24 may discontinue the Agreement not later than 14
days before the end of the month, however, without compromising the right of
blocking.

VI. Data Protection
- Herewith I permit Eurojob24 to use my personal
information, including but not limited to username, password, and IP address for
the purpose of my user activities.
- Herewith I permit Eurojob24 to use my personal
information as may be required to prevent fraudulent activities or activities
conflicting with this Agreement, in case documented evidences of such activities
do exist.
- Herewith I permit Eurojob24 to use my personal
information to investigate misuse of Eurojob24 Services and for legal
prosecution of discontinued Members, as well as to disclose this information to
legal authorities or third parties as may be required by law subject there are
documented evidences that such malicious activities do exist.
- Eurojob24 shall follow general rules regarding data
protection and shall not disclose or distribute personal information to any
third parties but for the above mentioned reasons.
VII. General Terms
- Members shall post their announcements into the appropriate categories. The
announcement text must be true and specify all relevant data.
- Announcement text and attached images shall apply to the offer in question
and shall not violate third party rights.
- Eurojob24 Members can use contacts from the announcement database only for
pre-sales communication. Members are not allowed to use contacts for advertising
or spam.
VIII. Agreement Assignment
Eurojob24 can assign its rights and liabilities
under this Agreement in whole or in part to a third party after giving a prior
four-week announcement. In this case Members can discontinue their registration
by sending an email to agb@wiarus.de.
IX. Waiver
Eurojob24 is not liable for violation of any rights
resulting from posting announcements or any other use of the announcement
database. Should a Member were responsible for such violation, he or she must
bear all costs, including legal, which may be required to protect Eurojob24 from
legal prosecution.
X. System and Database Integrity
- Members shall not use any hardware or software, which may
damage Eurojob24 infrastructure and/or announcement database. Members should not
take actions, which may result in unjustified load on Eurojob24 resources.
Members are not allowed to modify the content of Web pages generated by
Eurojob24 by any means or for any purposes.
- The Eurojob24 announcement database content cannot be
copied, distributed or used by any means (including automated search/crawling)
and in any way without the previous permission of the rights owner. The
Eurojob24 Web site layout and this Agreement can be copied and/or used only with
a previous written permission of Eurojob24.
XI. Limitation of Liability
- Eurojob24 is not liable for any possible damage incurred
to the Members, including loss of profit, unless it results from intentional
violation of this Agreement or criminal negligence of Eurojob24' representatives
or managers.
- Eurojob24 is not liable for any possible damage incurred
to the Customers, including loss of profit, unless it results from intentional
violation of contract terms and conditions or criminal negligence of Eurojob24'
representatives or managers.
XII. Correspondence, Applicable Law, Legal
Proceedings
- All correspondence regarding this Agreement must be sent
over email. For Eurojob24— agb@wiarus.de; for
a Member—his or her email address supplied during registration. Eurojob24
reserves the right to change its email address. In this case, Eurojob24 shall
promptly inform the Members about the change.
- If a user is a legal entity, this Agreement, including
these Rules, is subject to the substantive law of Federal Republic of Germany,
but for Incoterms. If a user is a physical person, this Agreement, including
these Rules, is subject to the substantive law of Federal Republic of Germany,
provided there is no conflict with the provisions of law regarding consumer
protection.
- In case Eurojob24 enters into a legal dispute resulting
from this Agreement or these Rules with a Member, which is a legal entity,
proceedings shall take place in Frankfurt-on-Main.
XIII. Amendments and Changes
- Eurojob24 reserves the right to change these Rules at any
time. In this case, new Rules will be sent to all Members over email no later
than two weeks before the Rules come into effect. If a Member does not notify
about his or her non-agreement within two weeks after receiving the email, he or
she is supposed to accept the new Rules.
- If these Rules become void in any part, this does not
mean cancelling other stipulations thereof. For void stipulations and absent
provisions the closest feasible term should apply by default.
